Confidentiality

At Prism Quality EAP, we recognize that confidentiality is of great importance to the employee. State and Federal law guide all clinical information released to and by the EAP. In all circumstances, except where applicable by law (see Release of Information Policy below), release of clinical information must be authorized by the employee.

In the event of accepted administrative referrals and mandatory referrals, the Supervisor will be informed regarding whether or not the employee contacted the EAP program and progress regarding continued participation. Release of confidential information beyond attendance and participation shall be maintained in the highest standards as protected by law and professional ethics.

Employees or family members may contact the EAP prior to utilizing the services to inquire about the confidentiality policy.


Release of Information Policy

The EAP program will not reveal information that the employee discloses to anyone outside the EAP unless:
  1. The employee provides written authorization;

  2. There is an imminent threat of harm to the employee or others, and a safety plan can not be agreed upon,

  3. There is reason to believe that a child under the age of 18 is being abused or neglected,

  4. Receipt of a court order and a judicial subpoena, or a

  5. Medical emergency.
